Probate will be necessary for most real estate that is not transferred into a Revocable Living Trust. This is a big deal if the property is in a state with awful probate laws. Arizona is not bad, but states like California, New York, and Florida, to name just a few, are horrible probate states.

Using a Revocable Living Trust will avoid horrible probate laws. How? You transfer your real estate into the Revocable Living Trust. You do this by creating a new deed for the property. The new deed says that you, as a human, transfer your interest in the property, to you, as trustee of your Revocable Living Trust. When the deed is recorded with the County Recorder, the real estate is part of the Revocable Living Trust. Property that is tied to a Revocable Living Trust avoids Probate.
